These Terms of Service ("Terms") govern your use of the lirkedir.click website and your booking of any photography session with Vignette Photography, a business owned and operated by Priya Nair ("Vignette," "we," "us," "our"), located at 1847 SE Clinton Street, Portland, OR 97201. By booking a session or using our website, you agree to these Terms.

1. Services

Vignette Photography provides documentary and lifestyle photography services, including family, newborn, couples, maternity, and event-style sessions, photographed on location using natural light. Specific deliverables (number of images, turnaround time, print credits) are described on our Pricing section and confirmed in your individual session agreement.

2. Booking & Payment

A non-refundable retainer (typically 30% of the session fee) is required to reserve your date and time.
The remaining balance is due on or before the day of the session unless otherwise agreed in writing.
Prices listed on this website are current as of the effective date above and are subject to change for future bookings; your quoted price is locked in once your retainer is received.

3. Cancellation & Rescheduling Policy

We understand that plans change. Our cancellation policy is as follows:

48-hour notice: Sessions cancelled or rescheduled with at least 48 hours' notice may be rebooked at no additional charge, subject to availability. The retainer will be applied to the new date.
Less than 48 hours' notice or no-shows: The retainer is forfeited. A new retainer will be required to book a future session.
Weather-dependent outdoor sessions: In the event of unsafe weather, we will reschedule at no charge; this does not count against the 48-hour policy.

As this is a personalized, scheduled service rather than a retail sale of goods, no statutory "cooling-off" or automatic refund period applies once a session has been performed; refunds for completed sessions are handled on a case-by-case basis at our discretion.

4. Image Delivery & Usage Rights

Edited digital galleries are typically delivered within 2–3 weeks of the session date via a private online gallery link.
Clients receive a personal print release permitting personal use, printing, and sharing of delivered images. This release does not transfer copyright, which is retained by the photographer.
Unedited or raw files are not included in any package and are not available for purchase.
Vignette Photography retains the right to use select session images for portfolio, marketing, website, and social media purposes unless the client opts out in writing prior to the session.

5. Intellectual Property

All photographs taken by Vignette Photography are the intellectual property of Priya Nair / Vignette Photography, protected under U.S. copyright law, regardless of the print release granted to clients. Commercial use, resale, or use in advertising requires a separate written licensing agreement.

6. Client Conduct & Session Expectations

Clients agree to arrive on time, disclose any location permissions required (e.g., private property), and behave respectfully toward the photographer and any assistants. Vignette Photography reserves the right to end a session early in cases of unsafe conditions or inappropriate conduct, without refund of the retainer.

7. Limitation of Liability

To the fullest extent permitted by law, Vignette Photography's total liability for any claim arising from our services is limited to the amount paid for the session in question. We are not liable for indirect, incidental, or consequential damages, including loss of anticipated images due to equipment failure, provided we make commercially reasonable efforts to prevent such loss (including on-location backup practices). In the rare event of equipment or data failure beyond our control, our sole obligation is to offer a complimentary reshoot where feasible or a refund of fees paid.

8. Website Use

Content on this website, including text, images, and design, is the property of Vignette Photography and may not be copied or reproduced without permission. You agree not to misuse this website, attempt unauthorized access, or interfere with its normal operation.

9. Governing Law & Venue

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles. Any dispute arising from these Terms or our services shall be resolved in the state or federal courts located in Multnomah County, Oregon, and both parties consent to venue and jurisdiction there.

10. Dispute Resolution

Before initiating formal legal action, both parties agree to attempt to resolve any dispute informally by contacting the other party in writing. If a resolution cannot be reached within 30 days, either party may pursue remedies available under Oregon law, including small claims court where applicable.

11. Changes to These Terms

We may revise these Terms from time to time. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
